Client Alert: USCIS Announces Final Rule for 540 Day Employment Authorization Extension

In the past, some EAD applicants were given a 180-day extension of work authorization, beyond the date of expiration, for certain, qualified employment authorization renewal applications. On April 08, 2024, due to extensive wait times, the United States Citizenship and Immigration Services (“USCIS”) announced a temporary measure to extend this to 540 days. On December 10, 2024, USCIS announced that this temporary measure will become the final rule on January 13, 2025. However, to be eligible, the applicant must meet certain USCIS requirements, such as timing and category of the filing. Please see the USCIS page for more details about eligibility.
