O-1B visas are reserved for individuals who have demonstrated a high level of skill, achievement, and recognition within the arts or film industries. “Extraordinary ability” means that a person has received distinction substantially above that which is ordinarily encountered, to the extent that the beneficiary is considered a renowned or leading figure in their field. Applicants must provide evidence of this national or international recognition, such as an Academy Award, Emmy, Grammy, or Director’s Guild Award, or evidence of at least three of the following:
To apply for an O-1B visa, petitioners must file Form I-129, Petition for Nonimmigrant Worker, with the USCIS within one year prior to the actual need of their services. It is recommended that this form be filed at least 45 days prior to the date of employment to minimize delays.
