The Temporary Foreign Worker Program (LMIA-Required)

The Temporary Foreign Worker Program (LMIA-Required)

The Canadian government has a Temporary Foreign Worker Program (TFWP) meant to temporarily hire foreign workers in areas where no Canadian citizen or permanent resident is available to fill. Typically, these areas are in high demand and need to be filled quickly. Applying for a temporary work visa through the TFWP requires that the company receive a positive LMIA assessment.
Approved work permits can allow temporary residency for a period dependent on the proper stream. These include:
High Wage Worker StreamFor employers who seek to hire a foreign national who will be paid at or above the median hourly wage from the province or territory they will be working in
Low Wage Worker StreamFor employers who seek to hire a foreign national who will be paid less than the median hourly wage of the province or territory they will be working in. Unlike the high wage worker route, the low wage worker route has additional requirements to be met to ensure a foreign worker’s safety and rights are safeguarded.
Agriculture Worker StreamSpecifically for agricultural workers to help Canada’s own shortage, particularly during peak seasons. Employers need to ensure that their production is in a sector on Canada’s national commodity list.
Global Talent Stream (GTS)GTS is for highly specialized employees that a company wishes to employ. Importantly, this stream does not require a positive LMIA, and the work permits are processed in about 10 business days. Employers must fit into the following categories: Category A- employers who have been referred to by one of the GTS designated partners and want to hire highly specialized workers. Category B- employers who want to hire highly specialized workers on the GTS Occupations List.
Home Care Provider StreamFor those who need to hire a foreign caregiver for seniors, those with medical needs, or children in a private setting. Families must follow the same procedures that employers undertake for the high and low wage streams, and they must provide evidence that a family member that needs in-home care, and that they prove they have the financial means to pay the caregiver’s wages.
Foreign Academic SteamFor foreign academics to work in Canadian universities to fill in-demand positions, as well as bring new knowledge to the campuses. Universities must follow the same procedures as employers going through the high wage stream. Many cases involve foreign nationals hired in research positions at post-secondary institutions, thus they may be exempt from needing an LMIA, a work permit, or both.
Specifics Regarding Quebec– The Quebec province has its own set of rules regarding foreign national’s ability to apply for a work visa via TFWP.
