Client Alert: USCIS Extends Green Card Validity Extension to 36 Months for Green Card Renewals

Permanent Residents who need to replace their physical green card due to loss, theft, damage or expiration must file form I-90 to request the issuance of a new card. When the Permanent Resident has filed form I-90 to replace an expiring green card, the I-90 receipt notice may be paired with the old green card to demonstrate continued status, often for purposes of travel or employment. Please note that this applies only while form I-90 is pending. Once adjudicated, the validity listed on the newly issued green card controls.

Previously, the I-90 receipt notice afforded an additional 24 months of card validity, past the expiration date. As of September 10, 2024, this duration of time has been increased to 36 months past the expiration date of the old green card. This additional time policy is implemented in light of increasingly delayed processing times.
