Please note that as of July 18, 2025, USCIS has received enough petitions to reach the H-1B visa cap. This includes both the regular cap and the Master’s cap.
USCIS will continue to accept and process petitions that are otherwise exempt from the CAP:
- Extensions for current H-1B workers
- Change of terms of employment for current H1B workers
- Change of employers for current H-1B workers
- Petitions to allow current H-1B workers to work concurrently in additional H-1B positions.
Please note that petitions filed for current H-1B workers who have been counted previously against the cap, and who still retain their cap number, are exempt from the FY 2026 H-1B cap.
USILAW has years of strong experience filing these types of petitions and is available to assist in the event that any petitioner needs assistance in this process. Please reach out to our firm with any questions and for assistance in this matter.
