OCTOBER 2015 VISA BULLETIN DUAL SYSTEM EASES TIMELINE TO FILE PERMANENT RESIDENCE

As part of President Obama’s Immigration Reform policies, the Department of State in
concert with the U.S. Citizenship and Immigration Services, has introduced a new dual
deadline system that will ease Permanent Residency Applications, especially for people of
Indian and Chinese citizenship. The dual deadline – one for Final Action and one for Filing
I-485 applications will come into effect on October 1, 2015.
The Final Action Date (for employment based applications) will denote the applications
actively being adjudicated on by the USCIS. The second Cut-off date will allow the Filing
of Permanent Residence Applications for additional applicants. This will then enable the
processing of Employment Authorizations (EAD Cards) and Advanced Parole (Travel
Documents) for those applicants. For Indian Nationals the Employment Based 2nd
category Final Action date is 01 May 2005 and for the 3rd Category is 08 March 2004.
The cut-off date for Filing of Permanent Residence Application however is 01 July 2011
for 2nd Category and 01 July 2005 effective for 3rd Category effective on October 1, 2015.
