The final action dates for Employment-Based categories EB-2 and EB-3 for Indian-born nationals have advanced from June 15, 2012, to July 22, 2012 (EB-2), and from September 22, 2012, to November 1, 2012 (EB-3). All other categories remained the same with no change from July to August 2024.
Beginning in June 2024, the Department of State expressed the possibility of a worldwide retrogression of final action dates for both categories EB-2 and EB-3 to keep the number of applicants within the maximum allowed under the Fiscal Year 2024 annual limit. The warning was removed for category EB2 in July 2024.
As of the August visa bulletin, the Department of State noted that retrogression was not necessary for this month, but as of September 2024 the worldwide final action dates for category EB3 may retrogress or become “Unavailable” temporarily due to the volume of pending applications already submitted.
