Through its rules under 8 CFR Part 214, the USCIS implemented new plans for processing H-1B Cap Petitions starting with FY 2021. As stated in our earlier client alert, in H-1B Cap seasons beginning with FY2021, petitioners will be required to pre-register their beneficiaries in an online system All registered petition will then be put through the selection process / lottery prior to the actual filing of the H-1B petitions. Only the beneficiaries who are selected from the registered pool will be eligible to have the petitioners file the H-1B petitions on their behalf.
The USCIS though new rules is now proposing to implement a fee of $10 per beneficiary for registration in the new electronic system. This fee will be in addition to the regular filing fees.
